Introduction

The Employment and Labour Relations Court (ELRC) is established under Article 162 (2) (a) of the Constitution of Kenya 2010. The Court is operationalised under the Employment and Labour Relations Court Act No. 20 of 2011. It is a specialised court with the status of the High Court. According to Section 29 of the Act, the Court is required to ensure reasonable, equitable and progressive access to judicial services in all counties. Currently, the Court is established in seven stations, namely; Nairobi, Mombasa, Kisumu, Nakuru, Kericho, Nyeri and Eldoret. In addition, there are eight (8) sub-registries located in Malindi, Machakos, Bungoma, Garissa, Meru, Kisii, Voi and Kitale.

Jurisdiction of the Court

The Court has original and appellate jurisdiction to hear and determine all disputes relating to employment and labour relations. These include:

1. disputes relating to or arising out of employment between an employer and an employee;
2. disputes between an employer and a trade union;

   Hon. Lady Justice Linnet Ndolo

   Lady Justice Linnet Ndolo was appointed Judge of the Employment and Labour Relations Court in 2012.

   She has served in Nairobi and Mombasa Stations.In addition to her court work, Judge Ndolo has served in the Committee on Development of Sexual Harassment Policy for the Judiciary, Committee on

   Development of Judicial Code of Conduct and Ethics and the Judiciary Performance Measurement and Management Steering Committee (PMMSC).

   She has also represented the Judiciary in the Working Group on Socio Economic Audit of the Constitution of Kenya, 2010. Judge Ndolo is currently serving in the Judiciary Rules Committee and the Employment and Labour Relations Court Rules Committee. She is a regular facilitator at the Judiciary Training Institute (JTI) and has made presentations at Judges’Colloquia.

   Before joining the Judiciary, Judge Ndolo worked for the National Council of Churches of Kenya (NCCK) between 1992 and 2011 where she held various positions; starting off as the Project Secretary for Human Rights in the Justice, Peace and Reconciliation Progra

   The claimant herein Justice Linnet Ndolo is a Judge of this court.  She filed this claim on 9^th February, 2012 and was later in July of the same year appointed Judge of this court.  She is therefore a sister Judge in this court.  Both counsels representing the claimant and the respondent were aware of this fact.  Indeed the claimant sits in court No.3
